Welcome to Our Space ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Our Space website, mobile applications, and related services (collectively, the "Service") operated by In Our Space. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement. The Service is intended for use by couples in a committed relationship. You are responsible for ensuring that your use of the Service complies with all applicable laws.

2. Account registration and security

To use certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@inourspace.net if you suspect unauthorized access.

3. Use of the service

Our Space provides an AI-assisted private space for couples to communicate, plan, and store memories. You may use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service to harass, abuse, defame, or harm any person
• Share content that is illegal, harmful, threatening, or that infringes others' rights
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Reverse engineer, decompile, or attempt to extract the source code of the Service (except as permitted by law)
• Use automated means (e.g. bots or scrapers) to access the Service without our permission
• Resell or commercially exploit the Service without our written consent

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

4. Subscription, payments, and refunds

Some features require a paid subscription ("Premium"). Subscription terms, pricing, renewal, and cancellation are presented at the point of purchase (e.g. App Store, Google Play, or our website). By subscribing, you agree to the applicable payment provider's terms. Fees are generally non-refundable unless required by law or the store's policy; refund requests should be directed to the platform through which you purchased (Apple, Google, etc.).

5. Privacy and data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to that processing. We use industry-standard measures and secure infrastructure (including Microsoft Azure) to protect your data; we do not sell your personal information.

6. Intellectual property

The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal use in accordance with these Terms. You retain ownership of content you submit; you grant us the rights necessary to operate and improve the Service (e.g. to store, display, and back up your content).

7. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. The AI-assisted features (e.g. message suggestions) are for support only and do not constitute professional advice. For mental health, legal, or other professional advice, please consult a qualified professional.

8. Limitation of liability

To the fullest extent permitted by law, In Our Space and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or one hundred dollars if greater). Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the maximum permitted by law.

9. Indemnity

You agree to indemnify and hold harmless In Our Space and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

You may stop using the Service at any time. You may delete your account via the in-app settings. We may suspend or terminate your access if you breach these Terms or for other operational or legal reasons. Upon termination, your right to use the Service ceases; we may delete or retain your data in accordance with our Privacy Policy and applicable law.

11. Changes to the terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date, and we may also notify you via the app or email where appropriate. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

12. General

These Terms constitute the entire agreement between you and In Our Space regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
